SEND Reforms Consultation Contribution

The official consultation for the SEND Reforms has now closed.

Background

On Monday 23rd February 2026, the government released their white paper “Every Child Achieving and Thriving.” This a document that sets out a long‐term vision and framework for reforming the education system in England so that every child and young person is supported to reach their full potential.

It outlines wide-ranging plans to improve schooling overall, alongside generational reforms to the special educational needs and disabilities (SEND) system.

First and foremost, it is very important to understand that a “White Paper” is not a change in law, it is a document that sets out the government’s ideas and proposal for change.

Responding to the government consultation

There will be a 12-week consultation, ending on May 18th. During this time, anyone can give their views on the white paper. This includes parents, carers, schools, professionals, parent carer forums, charities, and anyone who wants to support children and young people with SEND.

After the consultation ends, the government will look at the feedback and may potentially change some of its ideas.

Changes to the law and guidance will most likely needed, the government must bring a Bill to Parliament. Members of Parliament and the House of Lords will discuss it carefully. They can still suggest changes at this stage.

The Bill only becomes law when both Houses agree to it and it is given Royal Assent. Then it becomes an Act of Parliament.

Some parts of the White Paper can be changed through new policy or updated guidance. But anything already set out in law, such as the EHC process or the right to appeal, can only be changed if the law is changed.
