SEND Reforms 2026 Overview
Introduction
On Monday 23 February 2026, the government published its White Paper, “Every Child Achieving and Thriving.” This document sets out a long-term vision and framework for reforming the education system in England, so that every child and young person is supported to reach their full potential.
It outlines wide-ranging plans to improve education overall, alongside generational reforms to the special educational needs and disabilities (SEND) system.
First and foremost, it is very important to understand that a White Paper does not change the law. It is a document that sets out the government’s ideas and proposals for change.
A 12-week consultation period followed, during which anyone could share their views on the proposals. This included parents and carers, schools, professionals, parent carer forums and charities — anyone invested in supporting children and young people with SEND.
The consultation closed in May, and there have not yet been any further updates from the Department for Education.
Some aspects of the White Paper do not require any changes to legislation. These mainly include new support and funding opportunities for schools, colleges and early years settings.
Other proposals relate to areas that are currently covered by the Children and Families Act 2014 and the SEND Code of Practice, including EHC plans. Changes to the law would require the government to introduce a Bill to Parliament. The Bill would then be debated and examined by members of the House of Commons and the House of Lords, and amendments could still be made during this process.
Only once both Houses have agreed the final wording can the Bill receive Royal Assent and become an Act of Parliament.
IMPORTANT
We know that the release of the White Paper has caused a significant amount of worry and uncertainty for many families. The media is covering this by focusing in on the politics, and not necessarily the content of the reforms. What is not being stressed enough is the following:
This is a 10-year plan for reform.
Nothing will change immediately.
The plan does not include any changes to EHC Plans until 2029 at the earliest. It is business as usual where EHC Plans are concerned. This includes applying for a plan, issuing a plan, and the legal duties to deliver the contents of a plan. Also, all rights to appeal remain the same.
Changes will be introduced gradually.
Investment into support for parents and carers is also part of the proposed reforms, with funding for Information Advisory Services and Parent Carer Forums to be able to support families.
